Your personal data is processed by Nuno Miguel Martins Fernandes, Portuguese Tax Identification Number (NIF) 216913152, owner and manager of São Luis Faro Apartment, hereinafter referred to as “São Luis Faro Apartment”.
Nuno Miguel Martins Fernandes is the data controller within the meaning of the General Data Protection Regulation (Regulation (EU) 2016/679), hereinafter referred to as the GDPR.
Why do we process your personal data?
Your personal data may be collected and processed for the following purposes:
a) Compliance with legal obligations
To comply with legal and regulatory obligations applicable to the operation of the accommodation, including guest registration and communication obligations to the competent Portuguese authorities, as well as accounting, invoicing and tax obligations.
b) Management of your reservation and stay
To manage and perform the accommodation contract, including:
- processing and managing reservations;
- processing payments;
- managing check-in and check-out;
- guest identification and registration;
- managing security deposits, where applicable;
- communicating with guests before, during and after their stay;
- providing services associated with the stay, including cleaning, breakfast, transfers, grocery services or other additional services requested by guests;
- managing contractual obligations; and
- responding to requests made prior to a reservation.
The failure to provide personal data that is necessary to comply with legal obligations or to perform the accommodation contract may prevent São Luis Faro Apartment from accepting or completing a reservation or from providing certain services.
c) Communications and marketing
Where you have provided your consent, your contact details may be used to send information, news, offers or other commercial and marketing communications relating to São Luis Faro Apartment.
You may withdraw your consent to receive marketing communications at any time.
d) Protection and legitimate interests
Personal data may also be processed where necessary to protect the property, rights and legitimate interests of São Luis Faro Apartment, prevent or manage fraud, misuse or damage, resolve disputes, establish or defend legal claims, and carry out statistical or operational analysis.

Performance of a contract or pre-contractual measures — where processing is necessary to manage your reservation, stay, payments, check-in, check-out and associated services, pursuant to Article 6(1)(b) of the GDPR.
Compliance with legal obligations — where processing is required to comply with legal, regulatory, tax, invoicing or guest registration obligations, pursuant to Article 6(1)(c) of the GDPR.
Consent — where you have expressly agreed to receive marketing or promotional communications, pursuant to Article 6(1)(a) of the GDPR.
Legitimate interests — where processing is necessary to protect the accommodation, prevent fraud or damage, manage disputes, improve services or protect our legal rights, provided that such interests do not override your fundamental rights and freedoms, pursuant to Article 6(1)(f) of the GDPR.
How long do we keep your personal data?
Your personal data will only be retained for as long as necessary to fulfil the purposes for which it was collected.
Certain personal data may be retained for longer periods where this is required by applicable legal, tax, accounting or regulatory obligations or where necessary for the establishment, exercise or defence of legal claims.
Once the applicable retention period has expired and there is no other lawful basis for retaining the data, it will be securely deleted or anonymised.
Who may receive your personal data?
Your personal data may be shared, where necessary, with:

Portuguese public authorities and other competent entities whenever disclosure is required by law, including authorities responsible for guest registration, immigration, taxation, law enforcement or judicial matters.

- cleaning and maintenance service providers;

- providers of additional services requested by guests.
These service providers will only receive the personal data necessary to provide the relevant services and, where applicable, will process such data in accordance with contractual obligations and applicable data protection legislation.
c) Judicial, administrative or regulatory authorities
Personal data may also be disclosed where required by law, court order or a competent authority, or where necessary for the establishment, exercise or defence of legal claims.
São Luis Faro Apartment does not sell your personal data to third parties.
Are my personal data transferred outside the European Economic Area?
Some service providers, booking platforms or technology providers used in connection with the operation of São Luis Faro Apartment may process or store personal data outside the European Economic Area (EEA).

Withdrawal of consent does not affect the lawfulness of processing carried out before consent was withdrawn and does not prevent further processing where another lawful basis applies.
Where requests are manifestly unfounded or excessive, particularly because of their repetitive nature, we may charge a reasonable fee taking into account the administrative costs involved or refuse to act on the request, as permitted by the GDPR.
You also have the right to lodge a complaint with the Portuguese supervisory authority for data protection, the Comissão Nacional de Proteção de Dados (CNPD).
Security and confidentiality
We are committed to protecting your personal data and use appropriate technical and organisational measures designed to safeguard it against unauthorised access, loss, misuse, alteration, disclosure or destruction.
